Welcome to Klone. These Terms of Service ("Terms") govern your use of the Klone mobile application and website at getklone.app (collectively, the "Service") operated by Coastal Alps LLC ("we," "us," or "our").

By accessing or using Klone, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

To use Klone, you must:

  • Be at least 13 years old (or 16 in certain jurisdictions)
  • Be at least 18 years old to make purchases
  • Have the legal capacity to enter into these Terms
  • Not be prohibited from using the Service under applicable law

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account Registration

2.1 Account Creation

To use certain features, you must create an account by providing accurate and complete information. You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

2.2 Account Security

We reserve the right to suspend or terminate accounts that:

  • Violate these Terms
  • Are used for fraudulent or illegal purposes
  • Pose a security risk to the Service or other users

3. The Service

3.1 Description

Klone is an AI-powered image generation service that allows you to:

  • Upload photos of yourself ("Source Photos")
  • Generate AI images based on your Source Photos and text prompts
  • Save, download, and manage your Generated Images

3.2 Credits System

  • The Service operates on a credit-based system
  • Credits are required to generate images
  • Credits can be purchased through in-app purchases
  • Credit prices and packages are displayed in the app
  • Credits are non-transferable between accounts

3.3 Free Credits

  • New users may receive complimentary credits upon registration
  • Free credits are provided at our discretion and may be modified or discontinued
  • Free credits have no cash value and cannot be refunded

4. Purchases and Payments

4.1 In-App Purchases

  • All purchases are processed through Apple's App Store or other authorized payment processors
  • Prices are displayed in your local currency and include applicable taxes
  • By making a purchase, you agree to the payment processor's terms of service

4.2 No Refunds

All credit purchases are final and non-refundable, except:

  • Where required by applicable law
  • At our sole discretion for technical issues caused by us
  • As required by Apple's App Store refund policies

4.3 Price Changes

We reserve the right to modify pricing at any time. Price changes will not affect previously purchased credits.

5. User Content

5.1 Your Content

"User Content" includes Source Photos, text prompts, and any other content you submit to the Service.

You retain ownership of your User Content. By submitting User Content, you grant us a limited license to:

  • Process your Source Photos to generate images
  • Store your content to provide the Service
  • Create backups for data protection
  • Display your content back to you within the app

This license terminates when you delete your content or account.

5.2 Generated Images

  • Generated Images are created using your Source Photos and our AI technology
  • You own the Generated Images you create, subject to these Terms
  • You may use Generated Images for personal and commercial purposes
  • We retain no ownership rights to your Generated Images

5.3 Content Restrictions

You agree NOT to upload or generate content that:

  • You do not have the right to use (e.g., photos of others without consent)
  • Depicts minors in any inappropriate context
  • Is sexually explicit, pornographic, or obscene
  • Promotes violence, terrorism, or illegal activities
  • Is defamatory, harassing, or hateful
  • Infringes intellectual property rights of others
  • Impersonates another person for fraudulent purposes
  • Violates any applicable law or regulation

5.4 Content Moderation

We reserve the right to:

  • Review User Content for policy violations
  • Remove content that violates these Terms
  • Suspend or terminate accounts that repeatedly violate policies
  • Report illegal content to appropriate authorities

6. Acceptable Use

6.1 Permitted Uses

You may use the Service to:

  • Generate images of yourself for personal use
  • Create content for your social media, portfolio, or business
  • Generate images of others with their explicit consent

6.2 Prohibited Uses

You agree NOT to:

  • Use the Service to create non-consensual intimate imagery
  • Generate images of real people without their consent
  • Create deepfakes intended to deceive or harm
  • Use the Service for fraud, scams, or deceptive practices
  • Attempt to reverse-engineer or extract our AI models
  • Circumvent usage limits, security measures, or access controls
  • Use automated systems (bots, scrapers) to access the Service
  • Resell, redistribute, or sublicense access to the Service
  • Use the Service in any way that violates applicable law

6.3 Consequences of Violation

Violations may result in:

  • Content removal
  • Credit forfeiture without refund
  • Account suspension or termination
  • Legal action where appropriate

7. Intellectual Property

7.1 Our Intellectual Property

The Service, including its design, features, AI models, code, and branding, is owned by us and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute our software
  • Use our trademarks without permission
  • Attempt to extract or replicate our AI technology

7.2 Feedback

If you provide feedback or suggestions about the Service, you grant us the right to use that feedback without compensation or attribution.

8. Third-Party Services

8.1 Third-Party Providers

The Service relies on third-party providers for:

  • AI image generation processing
  • Cloud hosting and storage
  • Payment processing
  • Analytics

Your use of the Service is also subject to these providers' terms where applicable.

8.2 Third-Party Links

The Service may contain links to third-party websites. We are not responsible for their content or practices.

9. Disclaimers

9.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF RESULTS

9.2 AI Limitations

We do not guarantee that:

  • Generated Images will meet your expectations
  • The AI will produce perfect or consistent results
  • The Service will be error-free or uninterrupted
  • Generated Images will be suitable for any particular purpose

9.3 No Professional Advice

The Service does not provide legal, financial, medical, or professional advice. Generated Images should not be used for official identification or legal documents.

10. Limitation of Liability

10.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
  • LOSS OF PROFITS, REVENUE, OR DATA
  • BUSINESS INTERRUPTION
  • DAMAGES ARISING FROM YOUR USE OF THE SERVICE

10.2 Liability Cap

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

  • THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR
  • ONE HUNDRED US DOLLARS ($100)

10.3 Exceptions

Some jurisdictions do not allow limitation of liability for certain damages. In such cases, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your violation of applicable law

12. Termination

12.1 Termination by You

You may terminate your account at any time by:

Upon termination:

  • Your access to the Service will end
  • Your User Content will be deleted (subject to our data retention practices)
  • Unused credits will be forfeited without refund

12.2 Termination by Us

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or abusive behavior
  • Fail to pay for purchases
  • Upon reasonable notice for any reason

12.3 Survival

Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination.

13. Dispute Resolution

13.1 Informal Resolution

Before filing a formal dispute, you agree to contact us at support@getklone.app and attempt to resolve the dispute informally for at least 30 days.

13.2 Governing Law

These Terms are governed by the laws of Wyoming, USA, without regard to conflict of law principles.

13.3 Arbitration Agreement

You and Klone agree to resolve any disputes through binding individual arbitration rather than court, except:

  • Either party may bring claims in small claims court
  • Either party may seek injunctive relief for intellectual property violations

13.4 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES WITH US ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS OR CLASS ARBITRATIONS.

13.5 Opt-Out

You may opt out of the arbitration agreement by sending written notice to support@getklone.app within 30 days of first using the Service.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Posting updated Terms in the app
  • Sending an email notification
  • Displaying a notice when you open the app

Continued use after changes constitutes acceptance. If you do not agree to updated Terms, you must stop using the Service.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

15.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

15.3 Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

15.4 Assignment

You may not assign your rights under these Terms. We may assign our rights to any successor or affiliate.

15.5 No Agency

These Terms do not create any agency, partnership, or employment relationship.

17. Apple-Specific Terms

If you download Klone from the Apple App Store:

  • These Terms are between you and Klone, not Apple
  • Apple has no obligation to provide support or maintenance
  • Apple is not responsible for product warranties
  • Apple is not responsible for any claims related to the app
  • Apple is a third-party beneficiary of these Terms
  • You must comply with Apple's App Store Terms of Service
  • You represent that you are not in a US-embargoed country or on a US prohibited party list
